홍콩에서 광주까지: 멈추지 않는 인권회복의 여정 - 그 시작에 ALRC가 있었다

1998년 5월 17일, 광주 망월동 묘역의 정신은 '아시아인권헌장(Asian Human Rights Charter)'이라는 이름으로 다시 태어나 아시아 전역으로 뻗어 나갔습니다. 오늘날 우리가 기억해야 할 것은, 이 역사적인 선언이 가능하도록 보이지 않는 곳에서 헌신했던 홍콩의 아시아법률센터(ALRC)와 아시아인권위원회(AHRC)의 존재입니다.

1990년대 중반, 아시아 민주주의의 지적 허브였던 홍콩의 ALRC는 국가폭력에 대항할 수 있는 실질적인 '구제받을 권리(Right to Remedy)'를 아시아 전역에 뿌리내리고자 했습니다. ALRC의 상임이사 바실 페르난도(Basil Fernando)와 광주의 인권 운동가 서유진(Eugene Soh)의 운명적인 만남은 이 거대한 프로젝트의 시작이었습니다. ALRC는 3년에 걸친 치밀한 초안 작성과 법률적 검토를 주도하며 헌장의 '소프트웨어'를 설계했고, 광주는 그 헌장이 선포될 수 있는 성스러운 '공간'과 '피의 정당성'을 제공했습니다.

오늘날 홍콩의 시민들이 "임을 위한 행진곡"을 부르며 광주를 기억하는 것은 결코 우연이 아닙니다. 2023년 중국 정부의 거센 압박에도 불구하고, 5·18기념재단이 감옥에 있는 홍콩의 초우항텅 변호사에게 '광주인권상'을 수여하며 의리를 지킬 수 있었던 것은, 25년 전 ALRC가 광주에 심은 단단한 연대의 씨앗 덕분입니다. 광주인권선언은 단순한 문서가 아닙니다. 그것은 홍콩과 광주가 서로의 자유가 위협 받을 때마다 서로를 지켜주기 위해, 홍콩의 지성과 광주의 심장으로 함께 쌓아 올린 '인권의 요새'입니다.

From Hong Kong to Gwangju: The Unstoppable Journey of Human Rights Recovery – Initiated by ALRC

On May 17, 1998, the spirit of the Gwangju Uprising was reborn as the "Asian Human Rights Charter," extending its reach across the continent. Yet, what we must remember today is the invisible architect behind this historic declaration: the Asian Legal Resource Centre (ALRC) and the Asian Human Rights Commission (AHRC) in Hong Kong.

In the mid-1990s, serving as the intellectual hub for Asian democracy, the ALRC sought to institutionalize the "Right to Remedy" to counter state violence across Asia. The fateful alliance between Basil Fernando, Executive Director of ALRC, and Eugene Suh, a Gwangju human rights activist, sparked this massive project. The ALRC engineered the "software"—leading a meticulous three-year drafting process and legal framework—while Gwangju provided the sacred "hardware" and the moral legitimacy of its history for the Charter's launch.

It is no coincidence that Hong Kong citizens today sing "March for the Beloved" to remember Gwangju. In 2023, when the May 18 Memorial Foundation awarded the Gwangju Prize for Human Rights to jailed Hong Kong lawyer Chow Hang-tung despite fierce pressure from the Chinese government, it was harvesting the seeds of solidarity planted by the ALRC 25 years ago. The Asian Human Rights Charter is not merely a document; it is a fortress of human rights, built jointly by Hong Kong’s intellect and Gwangju’s heart, to protect each other whenever freedom is under siege.
